Officers responding to 911 calls found a 3-year-old girl dying, her 5-year-old brother beaten and Mr. Smith on the run. The motive for the killing provided another shock: the rage that ended in the death of the girl, Jeida Torres, was prompted by little more than a pair of soiled pants, investigators theorize.

Mr. Smith, 20, was arrested hours after Jeida’s death at an aunt’s house in Queens, where relatives said he slit his wrists, apparently in a suicide attempt.  He will face second-degree murder and other charges, said Kenneth P. Thompson, the Brooklyn district attorney.  The girl’s death was ruled a homicide on Monday by the medical examiner’s office, citing the cause of death as “blunt impact injuries of head and torso.”  The police said there had been no previous calls about domestic violence at the second-floor apartment, where the recently married couple had been living since July, or calls related to Ms. Torres and her children. A spokesman for the Administration for Children’s Services declined to comment on any previous involvement with the family.

The 5-year-old boy, Andrew, may have sought to intervene on behalf of his sister before being struck himself, officials said. He remained hospitalized at Wyckoff Hospital on Sunday.

Still, Mayor Bill de Blasio announced on Monday that his administration was doing an internal investigation of the city’s procedures and reviewing domestic violence and child safety in shelters as officials sought to understand what happened, and to prevent it from happening again.  We are all deeply saddened by the senseless death of an innocent child, and we are all responsible for our children’s safety,” Mr. de Blasio said in a statement. “We must find out what went wrong and what we could have done differently to avoid this terrible outcome.

Camille Rivera, a deputy commissioner for the Department of Homeless Services, said the agency would take immediate steps, including reviewing intake procedures to get more information about any domestic violence and child abuse histories, and reviewing tools to assess and better understand family dynamics and any potential safety threats to children or caretakers.

Something different today, we would like to know how you feel about Our new website…. OK, I am a bit scattered, I lookup from (uh-ohhhh, why are they both standing in front of me, and why are they both stareing at me) MY NOTEBOOK!!!!  OK, all clear.  That was Lia and Aida, the StrongBow Women;  bearing gifts in the form of a thermometer, a cool wet cloth, some kind of pills, a snack, and 500 questions.

I had mostly intended this for Our Circle, on our Google+ Page NOT IN MY WORLD!!!!, and thought I had made reference to the Comment Guidelines page and the About Our World page, since I thought this post was published about 7 hours ago. Sometimes waking up feeling a bit scattered is not such a bad thing if you just happen to remember that you have forgotten to do something REALLY IMPORTANT….  like introduce yourself to the WordPress Community

I am Blackhorn33, Administrator of NOT IN MY WORLD!!!! and the Google+ page of the same name.  I remember hearing some reference to “your own little world” or “yall’s own little world” for a good part of my life, and I never had to give it any consideration because the storm was here, and Dr Frankenstein(Frank) stood ready to attach the leads to the electrodes.  “Say When Dr Frankenstein”(Dr Frankenstein Frank shouting across the laboratory to Dr Frankenstein Blackhorn33), and with a nod I said “WHEN”, and just as a Woman screamed in the audience, someone backstage hollered out “IT’S ALIVE”!!!!

I didn’t have to look to validate what I knew already;  for in the length of a nanosecond, all the weight in the world had been lifted from our shoulders.  All of our hopes and dreams was reality and complete, and the Child Abuse and Indifference that followed with us from our youth, fled from it’s presence.

All I have left to say could take a lifetime, because it took a lifetime to see this day.  The people I owe, and will leave this world oweing, don’t go by no fancy rough-tough names like “The Wild Bunch” nor “The Hole-In-The-Wall Gang”.  Although a major part of them have traveled many miles, many times, out of Our Country, to places all over the world, even under water close to The North Pole in a submarine, all the while prepared to give their lives to keep US A FREE NATION.  We got a couple of CowBoys, a couple of CEOs, several very good Attorneys, one we call Medic, a Rabbit who takes care of us all, a Foster Parent who retired protecting us, an old friend who became a Ferrier one time who just came back into Our Life, Together We Heal, and many more I will mention later.  We Call Ourselves OUR CIRCLE, but without MY 2 GOLDHEARTS this point in time would be very different. While testing different search syntax, and noting the differences in how the news was filtered, I found this… 4 hours ago.
Two months ago, while putting together the NOT IN MY WORLD!!!! Google+ Page, I had already decided not to bring mine and Little Brother’s life into this.

The first part of our life wasn’t half bad. The reason being, it was spent with The Best Man I was ever to know. Our Father was a Good Man, who loved us, His Boys.

But that was just half the time.

We lived in fear, day and night, the rest of the time. We spent a good part of our early life around Military People, and on several bases. Our Step-Dad was Army Secret Service in Korea, then spent time in Vietnam with the Navy Seabees. For as far back as I can remember, we always believed in GOD. I know this because we prayed for GOD to kill us everyday. But we always thought GOD was mad at us, maybe we had done something HE didn’t like, OR maybe he just didn’t like us.

We always went to church, and we were Bullyed and physically hurt every service, by several boys.  This happened In PLAIN SIGHT OF MANY ADULTS, who never said one word to stop them, but would laugh at us or snicker. I KNOW all this was real and happened, because we were BEAT after every service.

If I had said this 2 months ago, this Child might still be alive.

EL PASO, Texas — El Paso police have charged a Fort Bliss soldier with capital murder after they say he beat his 2-year-old daughter to death because she soiled her diaper.

Police Det. Mike Baranyay says 20-year-old Dartarious Graham was arrested Sunday.

He says the U.S. Army specialist beat his daughter, Peyton Graham, with a belt Saturday. When firefighters were called to the home, they found her unresponsive. She was taken to an area hospital where she later died.

The child’s mother and the father’s cousin also were charged with injury to a child by omission.

Graham is being held at the El Paso jail on $250,000 bond. Online jail records didn’t indicate an attorney.

John Grisham Apologizes for Remarks on Child Porn

CNN – John Grisham is taking back statements he made about Child Pornography and Sex Offenders.

In a recent interview with the UK’s Telegraph, the lawyer and prolific author of books and Hollywood adaptations such as “The Firm,” “The Pelican Brief” and “A Time to Kill” sparked outrage when he expressed his belief that some people who view child pornography online are receiving punishments that don’t match the scale of the crime.

“We have prisons now filled with guys my age, 60-year-old white men, in prison, who’ve never harmed anybody (and) would never touch a child,” Grisham said during a conversation about high U.S. prison rates. “But they got online one night and started surfing around, probably had too much to drink or whatever, and pushed the wrong buttons and went too far and got into child porn. … They deserve some type of punishment, but 10 years in prison?

“There’s so many of them now, sex offenders … that they put them in the same prison, like they’re a bunch of perverts or something.”   He then used an old law school friend as an example:  “I have no sympathy for a real pedophile. But so many of these guys don’t deserve harsh prison sentences. A friend of mine, this was 10 years ago, was drinking, and his drinking was out of control. And he went to a website, and it was labeled, 16-year-old wannabe hookers or something, some stupid website. And it said 16-year-old girls. So he went there and downloaded some stuff.

“It was 16-year-old girls that look 30…  He shouldn’t have done it. It was stupid. But it wasn’t 10-year-old boys, and he didn’t touch anything.”  To Grisham’s recollection, the website his friend visited was actually a sting operation to capture sex offenders. He said his friend was then sent to prison for three years.  Those comments and the nature in which Grisham discussed the very serious issue of child pornography incited a flood of hurt, disappointed and angry reactions from fans.

“The day that you came out in an interview and said that watchers of child porn get too stiff of a penalty for it (you said 10 years was too much) makes you someone that I cannot support nor no longer want to read,” a reader named Kendra Benefield Lausman shared on Grisham’s Facebook page; another posted that she’s taken her entire Grisham library to her “burn barrel” with the intent to set the books on fire.  “How do you think child porn is made?” a poster named John Kelly asked on Grisham’s page. “Someone is still getting hurt you imbecile. I’m sad to say that I will never purchase, nor consume, one of your books ever again. I am disgusted.”  After the uproar began, Grisham issued an apology.

“Anyone who harms a child for profit or pleasure, or who in any way participates in child pornography — online or otherwise — should be punished to the fullest extent of the law,” the author said in a statement. “My comments made two days ago during an interview with the British newspaper The Telegraph were in no way intended to show sympathy for those convicted of sex crimes, especially the sexual molestation of children. I can think of nothing more despicable. I regret having made these comments, and apologize to all.”

That may not be enough for some of his former followers.  “You clearly said in the interview that people (like your drunk friend) who look at child porn don’t deserve severe punishment,” Facebook user Raylene Jolly Wheeler posted in response to Grisham. “Not sure how you can backtrack that statement.”

 

Plea Deal in 3 Year Old Girl’s Death

Iowa Day Care Provider Avoids Life Sentence

Orange City, Iowa An Iowa woman admitted Thursday to causing the head injuries that killed a 3-year-old girl at her in-home day care, but avoided a life sentence under a plea agreement with prosecutors.

Rochelle Sapp of Orange City pleaded guilty to involuntary manslaughter and child endangerment resulting in the death of Autumn Elgersma. Sapp told the court that she dropped the toddler to the ground. She also entered an Alford plea to child endangerment with multiple acts, meaning she did not admit guilt to that charge but conceded there was enough evidence to convict her of injuring the girl three other times over the prior eight months.

Prosecutors dropped a first-degree murder charge, which would’ve been an automatic life sentence for Sapp. Second-degree murder would’ve required a minimum of 35 years behind bars.  Instead, Judge Edward Jacobson sentenced Sapp to an indeterminate sentence of up to 100 years as called for in the plea agreement. That means there is no mandatory minimum, and it will be up to the Iowa Board of Parole to decide when to release Sapp.

Drake University law professor Bob Rigg said Sapp, 34, will serve “significant time” behind bars but nowhere near 100 years. He said her actual sentence might be around 15 to 20 years, based on the board’s prior practice for similar offenses.  Rigg said Sapp received a “significant concession” when prosecutors didn’t pursue a murder charge. In turn, she gave them a major concession by admitting to other crimes and avoiding a trial.  Prosecutors made the plea agreement public Thursday after keeping it secret since its Oct. 10 signing.

The case dates to Oct. 29, 2013, when Sapp called Autumn’s mother to say the girl was out of it after falling down the stairs when she went to play in the basement. Autumn’s mother left work and took the girl to a nearby hospital, where doctors diagnosed her with serious head injuries and had her airlifted to a South Dakota hospital. Doctors discovered a fractured skull and serious brain trauma. The girl died two days later, and a medical examiner ruled it a homicide.

Court records show that after failing a polygraph, Sapp changed her story about the girl falling down the stairs and told a detective she slammed the toddler to the ground after becoming angry because Autumn was having trouble taking off her coat.  DayCareProviderDeath-2014-10-18-1Sapp had argued that confession — and incriminating text messages police discovered after she let them search her phone — should have been suppressed. She argued she had not been read her Miranda rights and had barely eaten or slept for two days.  But Jacobson ruled Thursday that the confession and her consent to the phone search were voluntary, and that investigators “treated the defendant quite well.”
