KS CPS Bold Step Sent To Senate

Kansas House unanimously passes bill to release information after Child Abuse deaths

In a final vote Thursday morning, the Kansas House unanimously passed legislation that would require the state to release information after a child dies of abuse or neglect.

The chamber voted 124-0 in favor of the bill.  It now goes to the Senate, where lawmakers will decide whether to accept the House version.  If they don’t, the bill would be sent to a conference committee to work out any differences. After that, each chamber would vote again.

Child advocates say if the bill becomes law, the most vulnerable children in Kansas will be better protected.

“Absolutely it’s a step forward,” said Lori Ross, a long-time advocate in Missouri.  “Transparency is necessary for the child welfare system to continuously improve.  … I’m so thrilled they haven’t dropped this.”

The House action comes after several high-profile deaths in the recent years. Frustrated lawmakers, as well as child advocates across the state, have said more must be known about these cases so the system improves and other children are protected.

The Star has fought for years to obtain records and information after several horrific child deaths, including the 2015 death of Adrian Jones, a Kansas City, KS boy whose body was fed to pigs.

In a months-long investigation into the secrecy that permeates Kansas government, The Star found in late November a pervasive effort inside DCF to avoid transparency, hiding behind privacy laws and internal procedures — even instructing employees to shred notes taken in meetings where the death of a child was discussed.

Under the bill, SB 336, DCF would be required to release within seven business days the age and sex of the child, date of the fatality, a summary of previous reports to the agency and findings, as well as any department-recommended services provided.

Also, if a child dies while in state custody, the bill requires the DCF secretary to release the age and sex of the child, date of the fatality and summary of the facts surrounding the death.  This section relates directly to children who die in foster care and the death is considered an accident.

Since Secretary Gina Meier-Hummel took over the troubled agency in early December, she has vowed to be more transparent.  She worked with lawmakers on the bill and she and Gov. Jeff Colyer have been pushing for its passage.

As the bill went through the committee process there were heated moments as troubles with the child welfare system were discussed.  Lawmakers said this week that Meier-Hummel is providing the leadership that the state currently needs.

After Rep. John Carmichael commended the Judiciary Committee in a Wednesday hearing for its work with the legislation, he turned his attention to discussing Meier-Hummel.

“I also want to express to the current secretary of DCF my admiration for her first bringing the bill,” the Wichita Democrat said.  “And second, for responding frankly and candidly to sometimes difficult questions in the Judiciary Committee.”

Shaken Baby Syndrome

Shaken Baby Syndrome/Abusive Head Trauma (SBS/AHT) is a term used to describe the constellation of signs and symptoms resulting from violent shaking or shaking and impacting of the head of an infant or small child.  The American Academy of Pediatrics (AAP) describes SBS as a subset of AHT with injuries having the potential to result in death or permanent neurologic disability.

The #1 trigger for Shaken Baby Syndrome is frustration with a baby’s crying.

SBS/AHT is the leading cause of physical Child Abuse in the U. S.

Approximately 25% of victims of SBS/AHT die.

FAQ

Can Tossing My Baby in the Air or Rough Play Cause SBS?

SBS is a form of child abuse that happens when an infant or small child is violently shaken.  Shaken injuries are not caused by:

  • Bouncing a baby on your knee.
  • Tossing a baby in the air.
  • Jogging or bicycling with your baby.
  • Falls off a couch or other furniture.
  • Sudden stops in a car or driving over bumps.

Although the activities listed above can be dangerous and are not recommended, they will likely not cause SBS injuries.

Why is Shaking a Baby Dangerous?

Violent shaking for just a few seconds has the potential to cause severe injuries.  While shaking may cause injury to children of any age, children are most susceptible to being injured during their first year of life.  Factors that contribute to a baby’s vulnerability include:

  • Babies heads are heavy and large in proportion to their body size.
  • Babies have weak neck muscles.
  • Babies have fragile, undeveloped brains.
  • There is a large size and strength difference between the victim and the perpetrator.

SBS/AHT is well researched with over 700 publications in more than 100 peer-reviewed high impact medical journals.

Upwards of 80% of surviving victims of SBS/AHT suffer lifelong disabilities.

Approximately 25% of victims of SBS/AHT die.

Possible Signs and Symptoms of SBS/AHT
  • Lethargy / decreased muscle tone
  • Extreme irritability
  • Decreased appetite, poor feeding or vomiting for no apparent reason
  • Grab-type bruises on arms or chest
  • No smiling or vocalization
  • Poor sucking or swallowing
  • Rigidity or posturing
  • Difficulty breathing
  • Decreased level of consciousness
  • Seizures
  • Head or forehead appears larger than usual
  • Soft spot on head appears to be bulging
  • Inability to lift head
  • Inability of eyes to focus or track movement
  • Unequal size of pupils

spotting signs of Child Abuse

TOLEDO, OH  –  Twenty five-year-old Zach Shadix , the man accused of killing 8-month-old Gabrielle Walker, appeared in court Thursday.  Walker’s mother Lisa Eck spoke out about the crime saying she never saw it coming.

“I had woke up and went and made the baby a bottle like I do every morning.  I went to her bassinet to get her and she was black and blue all over the right side of her face,” said Eck.

Eck told NBC 24 Shadix lived with her, the infant, and her 9 year-old son for 6 months without any problems.  Child behavior experts at the Family and Childhood Abuse Prevention Center in Toledo say the one’s closest to you often commit crimes.

“A child is more likely to be hurt and killed by someone they trust,” said Dr. Christie Jenkins CEO of the center.

She deals with victims and their families, warning them of red flags.

“They’re scared, they cry they can be very clingy to the caregiver that’s not abusing them,” said Jenkins of the behavior of abused children.

While children might show a change in behavior there’s also the physical signs with odd-shaped bruises.

“When it’s abuse there’s typically circular motions there’s indentations of actual pieces of objects,” said Jenkins.

Even if an abuser isn’t harming a child psychically, there are often signs in the way they treat adults including getting easily frustrated along with being emotionally and physically abusive.

In addition to short tempers abusers will often have a rocky past.  Court documents show Shadix had prior charges in Lucas County for violent behavior.

“If they’re going to do that with you when you’re gone and that baby is completely helpless, they’re going to do that with that child,” said Jenkins.

Right now Shadix is in custody, while Eck says she’s still processing what happened to her child.

Frank, My Little Brother, was stricken with pancreatitis about the first of May 2017.

Wednesday February 7, 2018 at 2:00 pm CDT, Frank finished his job here, and was called home to be with Our Lord GOD.

Frank and I were born in Sweetwater Texas

He is preceded in death by R. E. our Father, and D. Kennedy, our Mother.

We attended school in Sweetwater until ****.

We graduated from H.G. Spruce High in Dallas, Texas.

Frank retired from the **** ** ******

Survived by Step-Father K.G. Kennedy of Dallas.
